A series of recent legal setbacks involving U.S. President Donald Trump has sparked fresh debate over the administration’s legal strategy, with conservative commentators suggesting that many of the defeats were caused by procedural missteps rather than the courts rejecting the administration’s broader authority.

During a discussion on The Bulwark, commentators Ben Parker and Sam Stein examined several high-profile cases in which the Trump administration has faced judicial setbacks despite many federal judges having been appointed during Trump’s first presidential term.

‘Procedure Matters,’ Say Commentators

According to Parker, some of the administration’s actions may have been legally permissible in principle but were challenged because established legal procedures were not fully followed.

One example discussed involved subpoenas issued to journalists during an investigation into alleged classified information leaks.

Parker argued that while the government generally has legal authority to seek such information, authorities are typically expected to exhaust other investigative options before compelling journalists to provide evidence.

Sam Stein added that courts found the administration had moved too quickly without first pursuing alternative investigative methods.

University Of Pennsylvania Request Also Highlighted

The discussion also referenced a separate controversy involving a federal request for information from the University of Pennsylvania during an investigation related to alleged antisemitism on campus.

According to the commentators, the administration eventually withdrew its request following legal challenges.

Judges Appointed By Trump Have Also Ruled Against Him

Parker also pointed out that several judges who have ruled against the administration were themselves appointed during Trump’s earlier term in office.

He argued that many of these judges continue to follow traditional conservative legal principles associated with institutions such as the Federalist Society, rather than automatically supporting executive actions simply because they were appointed by Trump.

According to Parker, these judges have demonstrated a willingness to scrutinise government actions when they believe legal procedures or constitutional limits have not been respected.

The discussion comes as the Trump administration continues to defend its policies in multiple courtrooms across the United States on issues ranging from election procedures to immigration and executive authority.
